The got milk? Think About Your Drink Family Challenge Contest (the "Contest") starts on August 1, 2007 at 12:01 AM Eastern Time ("ET") and ends on August 31, 2007 at 11:59 PM ET (the "Contest Period). One (1) Grand Prize winner and twenty-four (24) First Prize winners will be selected from all eligible entries received.

ELIGIBILITY: Contest is open to legal residents of the United States (excluding residents of Alaska and Hawaii, Puerto Rico and other U.S. territories and possessions), who are of legal age of majority in their states of residence (and at least 18 years of age) and who are parents or legal guardians of a child or children residing in the same home. Employees of the Milk Processor Education Program ("Sponsor"), Weber Shandwick, Family Circle and each of their respective parents, subsidiaries, affiliates, and promotion and advertising agencies, and members of their immediate families (spouse, mother, father, sister, brother, ward, daughter or son and their respective spouses, regardless of where they reside) and persons living in the same households of such employees, whether or not related, are not eligible to enter or win. Void in Alaska, Hawaii, Puerto Rico and other U.S. territories and possessions and where prohibited by law. Contest is subject to all applicable federal, state and local laws.

CONTEST ENTRY/OBJECTIVE: The objective of the Contest is to produce a photo that portrays your family choosing milk.

HOW TO ENTER: During the Contest Entry Period, visit www.thinkaboutyourdrink.com and follow the instructions provided to complete the Contest registration process and upload your photo and submit a caption for photo of no more than 50 words ("entry"). Photos must be submitted in JPG or GIF format and cannot exceed 600K in size. Entrants should have the consent of each individual appearing in his/her entry and, if any are minors, their parents' or legal guardians' consent to submit the photo in this Contest and grant the rights granted herein. Limit one (1) entry per person/email address per day. Multiple entries received from any person or email address for any given day will void all but the first entry received that day. Entries submitted by the same person/email address must be substantially different from any other entry submitted by such person/email address, as determined by Sponsor in its sole discretion. All entries must be received by 11:59 p.m. ET on August 31, 2007. For purposes of these Official Rules, "receipt" of an entry occurs when Sponsor's servers record the entry information resulting from entrant clicking the "Submit Entry" button. Any automated computer receipt (such as one confirming delivery of entry) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules.

By submitting an entry, entrant understands and grants permission for his/her entry to be posted on www.thinkaboutyourdrink.com for viewing by visitors to the web site. In addition to entrant entries, Sponsor reserves the right to post sample photos on www.thinkaboutyourdrink.com. These sample photos will not be included in the judging and will not be eligible to receive prizes. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties.

Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the entry contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the entry. If any identifiable person appearing in the entry is under the age of majority in his/her state of residence, the parent or legal guardian is required to provide permission Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. By submitting an entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the entry consent to the submission and use of the entry in the Contest, including his/her name and likeness, and to its posting on www.thinkaboutyourdrink.com in connection with the Contest.

Entries must comply with the following content guidelines to be eligible:

  • Content cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity;
  • Content cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
  • Content cannot be obscene or offensive, endorse any form of hate or hate group;
  • Content cannot defame, misrepresent or contain disparaging remarks about other people or companies;
  • Content cannot contain trademarks, logos or trade dress (such as distinctive packaging (e.g, identifiable soft drink can or bottle) or building exteriors/interiors) owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • Content cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission;
  • Content cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
  • Content cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and
  • Content cannot depict and cannot itself be in violation of any law or otherwise.
  • Sponsor reserves the right to disqualify any entry for any reason, in its sole and absolute discretion.

JUDGING: All eligible entries received will be judged by a panel of qualified judges based on following criteria: (1) portrayal of milk as a beverage choice in the family's life (50%); (2) creativity (25%); and (3) originality (25%) ("Judging Criteria"). In the event of a tie, an additional, "tie-breaking" judge will determine the winner(s) based on the criteria listed herein. Sponsor reserves the right to not award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Judges' decisions are final and binding on all matters relating to this Contest.

WNNER NOTIFICATION: Potential winners will be notified by telephone, mail and/or email and will be required to execute an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), which must be returned within ten (10) days of date appearing on prize notification. Potential winners may also be required to have each individual (and, if a minor, his/her parent or legal guardian) execute and return a liability/publicity release within the same time period. Return of prize or prize notification as undeliverable, failure to sign and return all requested documentation within ten (10) days of date of issuance, or noncompliance with these Official Rules by the any potential winner will result in disqualification and, at Sponsor's discretion, the prize may be awarded to the applicable runner-up.

A background check may be conducted on each potential winner. At the discretion of the Sponsor, a potential winner may be disqualified for any of the following: if charged with or convicted of a felony or misdemeanor, is not eligible based on the eligibility requirements set forth above, or if delinquent on a government ordered payment, such as but not limited to: child support, spousal support, alimony, tax payments, etc. In the event it is determined that a potential winner has not complied with these Official Rules, has failed to execute and return any required documents within the specified time period, has made false statements or a notification is returned as undeliverable, then potential winner will be disqualified. If a potential winner is disqualified for any reason, at Sponsor's discretion, the entry with the next highest score may be declared the alternate Finalist.

PRIZES: Grand Prize (1): One (1) Grand Prize Winner will receive a four (4) day/three (3) night trip to Disney World for winner and up to three (3) immediate family members (i.e., spouse and two (2) children) (each, a "guest"). Approximate Retail Value (ARV): $7,000.

Prize includes round-trip coach air transportation to/from a major U.S. gateway airport nearest to Winner's primary residence, round-trip ground transportation between destination airport and hotel, three (3) nights' standard hotel accommodations (one (1) room, quadruple occupancy), four (4) Disney World passes and $500 cash for Winner only which may be used towards meals. Actual value of trip depends on location of winner and airfares at time of departure and dates of travel. If actual value turns out to be less than stated ARV, the difference will not be awarded. Winner and guests must travel together on the same itinerary on dates specified by the Sponsor or forfeit all rights to prize. All travel arrangements must be made through Sponsor's agent, on a carrier of Sponsor's choice. Travel must be taken by December 31, 2007 or prize will be forfeited and Sponsor will have no further obligation to winner. If winner resides within a 100 mile radius of destination, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel restrictions may apply. Winner and guests are responsible for obtaining proper documentation (e.g., valid photo ID) prior to travel. Guests will each be required to complete and return a Release of Liability and a Publicity Release (where permissible) prior to travel. If any guest is a minor, Release of Liability and a Publicity Release (where permissible) must be signed and returned by his/her parent or legal guardian. Passes are subject to terms and conditions specified by Disney World. Winner and guests must comply with all park rules and regulations. Failure to do so may result in forfeiture of Disney World Pass portion of prize.

First Prize (24): Twenty-four (24) First Prize winners will each receive a prize package including a Family Circle Cookbook, and five (5) dinners for winner and his/her immediate family prepared by a chef, as further described below. Approximate Retail Value (ARV): $1,000 each.

Chef selected by Sponsor will cook three (3) dinners for winner and his/her immediate family and deliver these dinners, fresh, to winner's home and such chef will also will prepare two (2) additional dinners that the winner can store and serve to his/her family at a later date. All five (5) meals will be delivered together at the same time. Exact dates and times chef will visit winner's home is subject to availability and will be mutually agreed upon between Sponsor and each winner.

General Prize Conditions/Restrictions: Total ARV of all prizes: $31,000. All prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. No substitution, transfer, or cash equivalent of a prize is permitted, except by Sponsor, which reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Any and all federal, state and local taxes on the prize, and any other costs, fees, and expenses associated with prize acceptance and use not explicitly stated herein as being awarded, including, without limitation, additional ground transportation and meals in connection with the Grand Prize, are the sole responsibility of the winner.

OWNERSHIP/USE: Entrant hereby acknowledges that entry (including photo) and all other materials of every kind whatsoever created by entrant relating to the Contest(collectively, the "Work") are a "work made for hire" (as that term is used in the United States Copyright Act) for Sponsor, and Sponsor is the sole and exclusive owner, in perpetuity and throughout the universe, of all right, title and interest in and to the Work, including without limitation all copyrights in and to the Work (and all renewals and extensions thereof now or hereafter provided by law) and all the rights therein and thereto, and may exploit the Work (and all rights therein) in any manner throughout the world without restriction. Without limiting the binding effect of any of the foregoing provisions, in the event that any part of the Work is not deemed to be a "work made for hire" for Sponsor, then entrant hereby irrevocably and exclusively grants and assigns to Sponsor (or, if any applicable law prohibits or restricts such assignment, entrant hereby grants to Sponsor an irrevocable, perpetual, royalty-free, transferable license of) unlimited right, title and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised.

By submitting an entry, entrant acknowledges and agrees that Sponsor may obtain many submissions under this Contest and that such entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other contests staged and/or sponsored by the Sponsor, and waive any and all claims contestant may have had, may have, and/or may have in the future, that any composition, design, photo and/or other works accepted, reviewed and/or used by the Sponsor (or its respective designees) may be similar to his/her entry. Entrant acknowledges and agrees that the Sponsor does not have now, nor shall ithave in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant's entry.

GENERAL: By participating, each entrant agrees: (a) to abide by these rules and decisions of Sponsor and judges, which shall be final in all respects relating to this Contest; (b) to release, discharge and hold harmless the Sponsor, Weber Shandwick, Family Circle and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize (including any travel or activity-related hereto); and (c) to the use of his/her name, voice, performance, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

Released Parties are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed entries or photos; all of which will be void. Released Parties are also not responsible for problems uploading or downloading any Contest-related information or materials from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a entrant's ability to participate in this Contest. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes or in any Contest-related materials. Mass entries, or entries generated by a script, macro or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest and, if terminated, at Sponsor's discretion, determine the winners using all non-suspect, eligible entries received up to time of cancellation using the judging procedure outlined above. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Sponsor reserves the right at its sole discretion to disqualify any individual (and void his/her entry(ies)) it finds to be tampering with the entry process or the operation of this Contest or website, intending to annoy, abuse, threaten or harass any other entrant, Sponsor or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by a entrant to deliberately damage any web site or undermine the legitimate operations of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law and to disqualify such entrant from the Contest.
